Default Question on I-485 filling

Hello,

I filed my 485 under employment category. However, recently I got married and she is an US citizen.

I am planning to file new 485. One of the question in the 485 form is: current USCIS status and expiration date: I understand my current status would be I-485 parolee (since last time I entered US using Advance parole while pending 485).

My question: what do I enter under expiration date?

I appreciate any answer.

I've worked for Company A and got my labor and I140 approved in 2005. Later I switched to Company B where i got my labor and I140 approved in 2007. Now the PD is current for the labor filed through Company A. My previous employer is not in good terms. As they did't provide me the receipt number I don't even have any details regarding my first I140. Is there any way I could find it out from USCIS? Is there any way to port in the PD for the first labor. Guys plz. throw some light, now the PD is current for EB2. I dont want to waste it.

Hello All!
My wife, who is an american citizen, is filing for my immigration tomorrow and I would like to double-check the forms and documents before she applies. Here is what I would have in the envelope:

-> Form i-130
-> Form i-131
-> Form G-325(a) (each for me and my wife)
-> Form i-485
-> Form i-693
-> Form i-765
-> Form i-864

We are also including a copy of both of our passports, her proof of citizenship of USA, a copy of our marriage certificate, passport sized photographs, a copy of my current B2 visitors visa and a copy of my i-94 card. I also have my birth certificate copy enclosed.
Now I would like to know if we have to put in more evidence of our marriage , like photographs of our marriage and/or previous photographs through our relationship. Also, do i need to include a copy of each and every page of my passport and the back of my i94 card? Do we put in all the forms in the same envelope and drop it at the drop-box in chicago?(That is where we live).
Importantly, in my case, do i need to get my medical checkup done before filing for immigration? Lots of confusion here!
A Final question - how long does it take these days for processing of EAD and AP? I know there is no fixed timeline, but what is the current trend in a case like mine where its sponsored by spouse.
I know these are a lot of questions, and all prompt replies will be highly appreciated. Thanks!

I am currently spending my 3 years of living in the UK. It is fairly easy to find a job if you are dedicated and hard-working. The UK visa is the hardest part of the whole experience but I would definitely recommend it to anyone.

Default 2nd Employer filing Labor without working

I have EAD EB-3 approved in Aug 2006. Even though I have qualification to file EB-2, employer is not doing. Can I ask other employer to file EB-2 without working. After EB-2 approval and GC, Can I stay with the EB-3 employer? Will it be offence?

Default Advance parole Travel

Hi any one help me,

I have valid current Advance Parole and new Advance Parole. My travel date is in between two Advance Parole date.

I am going to India with Current Advance Parole and come with new Advance parole that approved recently.
Because while coming to USA the current will expire and I need use the new one.

Can I use two different Advance parole for my travel ?

I have I485 Approved waiting for PD

The Subsidiary that I work for has been sold by the parent company ( that I have my H1B and I485 with ) - the New Owner Company is saying that they can 'transfer' my H1B but will have to Restart my EB3 application all over again - delaying the process by another 4-5 years ! - will I have to go back thru Labor Cert and await the Whole process again or are there any other options?

File FOIA request with your A number. (http://immigrationvoice.org/forum/fo...-notice-3.html (FOIA to get copy I-140 Approval Notice?)). Currently it takes approx 6-7 months to get FOIA respond.

In FOIA request provide your A number to search record and request your complete immigration information.

it is actually my I140 that has been approved waiting on POD for I485 Filing

Hello,

Has the eligibility to e-file the AP changed?. I am listing out the text set out in the USCIS web page

USCIS - Instructions for Electronic Filing of Form I-131 (Advance Parole Document)

Who is Eligible to e-File Form I-131?

Form I-131 can only be e-Filed if you seek an Advance Parole Document, currently reside in the United States, and have been granted Temporary Protected Status (TPS).

I have been e-filing the AP and dont recall seeing that information before. Hopefully anybody who has recently e-filed AP can chime in.

Default EB3 to EB2 PD port + I140 + I 485

I have a EB3 PD of Mar 2008. I already have an LC approved and I140 that will be filed in EB2 with request for PD porting from EB3. Is it possible to apply for I485 concurrently in the anticipation that I140 will have the PD that's current at the time of application?

Any suggestions? Should I wait till I receive the I140 receipt? Or should I wait till I140 is approved?


Can you help me understand whether my application is eligible for concurrent filing?

Unhappy Filing I 485 as a dependant and out of status in past due to delay in filing H4

I'm in a mess right now. Please help. I've been in US over 8 years.

My spouse who is a primary will file for I 485 next month on EB2 .

I'm on H1b aswell and 2.5 years ago when I was with my first employer on h1b , my then employer revoked H1b in June and he did not inform me and I came to know only in Aug ( after 2.5 months ) and employer advised me to immediately apply for H4 . SInce I was on bench during that time he ran payroll and generated pay stub for one month in July and applied for my h4 using my spouse's H1b . I got the h4 approved and after 2 months I got H1b sponsored by another employer #2 and briefly went on h4 during transition to my third employer #3 ( current ).

When employer revoked H1B , I never received any letter from USCIS.

Now, I'm ready to file for I 485 as a dependant and I'm scared as hell for those 2 months. Now in one of the forms ( g325 I guess) I need to give employment dates. My former employer is suggesting that I use dates covering the gap between H1 revoke and H4 and include that as being employed inorder not to draw attention from uscis.
He said he will support if an RFE comes .

Please advise . BTW I have not travelled outside US since this happened so it is with in the check .

Default 2 PERM's

1st Perm EB2 (Team Leader) Oct 2007 (went through 2 Audits and then denied, then appealed)
2nd Perm EB2 (Project Leader) May 2010 (filed parallely with Perm 1 being appealed)
1st Perm Approved
2nd Perm Denied
Lawyers say that denial was on employment and hence appeal and tell me no impact on my Perm 1
Meanwhile I get current file 485, get EAD/AP
After 1 and a half years, DOS appeals Perm 2 which was appealed
Lawyer is saying we should not withdraw as both positions are similar and should reply to the audit and will not have impact on my Perm 1 which is approved/certified

Please suggest if withdrwal is a better / safer option or appeal on Perm 2 will have no impact on Perm 1 and hence is also safe?

Default Mismatch between Birth Cert & Passport

Hi,

I have sent my documents for the i-485 application processing. I am having this below 2 issues.

1. My wife's Birth Certificate specifies the Place of Birth as Vasco Da Gama, Goa, India. However in Passport and the affidavit we got from her father, the pace of Birth is mentioned as Goa, India. Would that be an issue?

2. In my Birth Certificate, my mother's name is mentioned as Kumuthavally. However in my passport and in the affidavit from my father, we have mentioned my mother's name as Kumuthavalli. Spelling mistake in the last character. Would that be an issue?

I would highly appreciate if somebody can throw some light on this.
