Default H1B Transfer, Please Respond

Hi All,

I am working with Company A on H1-B for the past 2 years, I recently got a full time offer with Company B, they are in the process of H1-b transfer, My LCA was denied for some reason( attorney's told me it have nothing to do with me and it was because of this new icert system) they have refiled my LCA- My QUESTIONS are

1) Does it always take 7 bizz days to get the lca approved ( my first lca was denied on the 7th day) and its been 5 days already since the re-submission and no approval yet?

2) I have master's in aerospace/Mechanical and my H1-B is SOFTWARE ENGINEER.. will it create any issue in the transfer (since its a new petition),since I already have 2+ years of experience in IT now and the new job is the continuation of the responsibilities?

1. The speed of LCA processing generally depends on the work load at a particular time in the LCA office of the labor department. It does not necessarily takes 7 days.

2. The fact that you now have more work experience does not relate to the job requirement in the H1B petition. As long as your qualification satisfies the job requirement and it is a professional job, it should be fine.
