Default Going Back to Former Employer

Hello,

I am on EB2 with Dec 2006 priority date. I got my I-140 from company A. Due to family circumstances, I used AC21 and started working for company B on EAD in a different state. Now company A is offering me a good position in a different location.

Can I again use AC21 and go back to company A? Please advise.

Thanks in advance.

As you wait for a lawyer to respond to your question, let me add my comments to it:
1. You can use AC21 to return to your original sponsor. You don't have to worry about the location as AC21 will take care of that. However, send a letter to USCIS notifying them of the change to avoid any issues later on.
2. If your H1B is still valid with your original sponsor, you can use the same H1B by leaving the country and re-entering using the H1B visa. I'm pretty sure this is a valid option. The attorneys here can validate my answer.

Good luck, pal!
