Default H1-B Visa, Advanced Processing delays Under Section 221(g)

Hi,

As most of us know about advanced processing issue during H1-B visa stamping. I have seen several forums, petitions, and weblinks talking about people stuck in India, Canada or other part of the world due to extremely slow execution by US embassies. I was given a pink slip in New Delhi Embassy on Feb 8th and the suggested processing time is 4 to 8 weeks. They ask us not to contact US embassy because there is no Cause for concern. My visa is still pending. I am wondring if I have any rights in this case to know what is going on with my visa application. How long will I be in this limbo? Is ther any provision in US or Indian law that forces USCIS to commit to a decision date? Can we pay extra for premium processing?

Thanks for writing on my thread but in my opinion need is both ways. Legal immigrants are paying the taxes as well so US goverment shoould be accountable to at least have fairness in this process and there should be more transparency into visa approval process. If US wants to retain big tech employers (Microsoft, Google, IBM, Intel, Qualcomm etc..), uncle Sam will have to give them the freedom to decide who gets the payroll. It is a need for US to get the economy going through these big tech firms by retaining them in US and get huge amount of money as taxes. If people like me can not work from US, we will work from India, China, Russia, Hong Kong or Latin America ....Same US employer will hire less in USA ...So need is their's too.

Currently US immigration is functioning highly illogically. Someone has his H1-B petition approved while he is in US and there is no security threat if he stays in US for 3 years and never leave but the same person has to go through advanced processing if he is honest and showing up at US embassy for visa stamping. How ironic and sad?? The smartest country in the world can't think smart when it comes to immigration. I seriously have doubts about the qualification of visa office employees and looks like they don't have good process and measures to figure out who is a deserving person for visa and who is not. When someone has US social security number why does it take more than 2 weeks to find one's records and do the background/security check. The only reason I can think of this delay is excessive work load at visa offices and lack of processes in place. Why don't they start the advanced processing for all resident alien H1-B visa holders when they are in US before approving their petition. This is annoying and injustice to an honest, well behaved and tax paying community called non-immigrant workers.

Not having any access into this processing, waiting remians the only choice... a horrible one for some of the brightest and the best individuals!
