Default From F1 to H1-B

Hi All,

My papers has already been submitted for H-1B. I am currently on my OPT which expired on June and I got extended until September 30, 2010. Do I need to leave a country during 30 days after my H1-B got approved?

If the approval notice contains I94 no need to leave the country otherwise you need to get the H1B Stamped.

Are there any rules that you need to leave a country during 30 days after your H1-B got approved. Almost all my friends needed but my lawyer said that I don't need to. I am confused what if he makes a mistake.

No, you do not need to go out of US if the I-797 (H1-B approval) comes with an I-94 card.

If the petition is approved under Consular Processing then they need to leave the country. Other wise no. The reason for Consular Processing would be not maintaining the status continuously.

If you get I94 along with the approved H1B then you are fine. If not, you need to leave the country and get it stamped. Your other friends might have not got I94 along with their approved I94
