Default H1 - Cap Exempt Consultant

All,

Apologize for posting a message which does not relate directly to non immigrant visa but I am looking to find out if any of you could point me to any consultants who place candidates to higher Ed institutes in the H1B cap exempt category. Any help in this regard will be highly appreciate

You might want to know that almost all higher ed institutions only hire directly. The whole idea of consulting and soliticing resumes through a 3rd party is a big no no at the public colleges or higher education institutions. I hope you were not trolling.

Also for exempt status, you need to be an employee of the higher ed institutes/govt and not work as contractors through some other company. As a contractor, you are not eligible for the cap exempt status.

Plus higher ed institutes dont do that 3rd party contractor thing.

Your cap-exempt status is determined by the "employer", not the client place you work. If you are an employee of a consulting company, your "employer" is the consulting company regardless of where you actually work. So unless your consulting company can be qualified as "non-profit", you would not be cap-exempt.

Based on this link from murthy.com looks like 3rd party organizations that place people in higher ed domain are eligible to file h1b in cap exempt category.

However, as a process if higher education folks do not work with 3rd party organizations in general, then I guess this information is not relevant. The reason I wanted to get feedback from folks here on this forum because I am not sure how the higher ed recruitment works. There is no feedback mechanism if I apply directly to these institutes. My intention definitely was not to troll.
