Default H4 - H1 Change of Status
Hi,

I got H4 visa in 2007. Then I never traveled in USA. Then I applied for H1 visa and Stamped it successfully in 2008.

Then, I entered USA on H4 visa as I did not have work to start with for my H1B. At the immigration they asked me on what visa you want to enter and I said H4 visa.

They allowed it but now if I want to convert H1 from H4, then do i need to go out of country and reenter or I can simply do Change of Status from H4 to H1 ??

Please advice, it is very much urgent.

I am not sure if your H1B is still valid. If so, you might need to apply for Change of Status. Why dont you ask this question to the section.....Ask a Lawer for Free here.
