Default H1B RFE's for 2010

I applied to H1B this year with a company that cannot be categorized under 10/25/10 description of USCIS. Meaning makes less than 10 million, employs less than 25 people and recently established. The USCIS is asking for an outrageous number of evidence some of which can not be provided by my company(i.e. classified ads for my job offer or detailed client lists)It looks like they are trying to do everything they can in order to reject my application.

Does this mean that I should be answering and sending supporting documents to every single thing they ask? If I can not provide some of the evidence that they ask among million other things they are asking would that lead to a rejection? Please help! Thanks.

Wink No - Not at all

They won't reject your application. USCIS likes playing CAT and MOUSE game with the applicants. They are just having some fun with you. They will approve your petition even if you do not submit what they requested

On side note: If you din't get my sarcasm. Try to do your best and submit most of what they requested and an explanation as to why you cannot submit the other stuff. After that you can just pray and hope. Have a backup plan.

Default H1B RFE ( OPT- H1, H4-H1, H1 Transfer etc)

I would like to post some realtine scenarious new H1B Applicants facing recently ( H1B extensions and transfers also)

Most RFE:

RFE:Submit an itenary of work sites the beneficiary is assigned to, specific dates , locations and the name of each work site where beneficiary services will be delivered.

Submit all signed work orders with address and telephone where a contact can be reached.

If beneficiary will work on an inhouse project, submit evidence describing project, length of time of project, teams menmbers assgined to project, job duties titles and invoices showing the sale of products to its customers.

So all new applicants , better be well prepared to answer this type of questions.

Unfortunately many applications also been rejected for in ability to answer questions satisfactorly.

Rejections are happening even for Big Boys (Major Companies).

My sister's application (OPT-H1B) got an RFE asking if the company had received TARP money. Company lawyer responded saying the company did not receive TARP money and she got an approval.

If you cannot provide some requested information, you better add the exact law point and show that, why that cannot be used as a cause for rejection. Also add an explanation why that information cannot be provided.
