H4 to F1 change of status denied.

Hi,

I am on H4 VISA. I have applied for a change of status from H4 to F1 in Oct 2010.As my H4 I94 is valid till Oct 27th 2010,we applied for an extension along with my spouse H1B and got approved extension till 2014 in Dec 2011. 2days back I came to know that my F1 is denied.

My question is: Since I have a valid H4 I94 till 2014 and my F1 COS is denied can I stay on my H4 and continue my studies or should I go back to my home country and return on H4.We still dont know the reason for F1 denial.

You are currently on H4 and will continue to remain on H4 till the date your H4 is valid / till a change of status to another visa is approved.

If the change of status to F1 was approved and if you travel outside US, you would have had to plan about stamping.

But for now you are legally on H4 and can continue studying on H4. Talking to the international affairs at your school may keep your mind at ease

Well,I have talked with my International Advisor and they told me that my status is good and I can continue my studies and stay.

Hi Mitr,

I am about to apply for change of status from H1 to F1 and need to know the chances of denial. I have an I-140 approved and wondering if that was the reason for denial?

If you know the reason, could you please share the reason for your F1 COS denial?

Hi Mitr,

You can stay in US on H4 visa and continue studying.
But you cannot apply for summer internship or OPT while in H4 visa.

Do you have any plans to reapply for F1 ?
