Student Visa HELP

My Fiancee came to the US on tourist visa in 2010
She was in the US few times, in 2010 she decided to start college here.
She successfully changed the status from tourist to student .

In 2011 Her mother came down with cancer and she had to go for two weeks before the start of the new semester.

School had contacted the ins and they confirmed that her status as a student is valid and see no reason not to go and comeback. he just had to get the new visa stamped into her passport at local embassy no big deal right ?

Wrong
Embassy worker denied to stamp the passport stating that she worked because her grades slip ( remember she has a very sic mother )
She went there 3 times each time denied by the same person .

during her last visit the worker told her she is lucky since she still has a valid tourist visa

She lost a full year of education , never worked a day while in the us ( came from very well to do family)

My question is
Can she try coming back on the tourist visa? ( she is terrified that they will detain her )
it will be a full year since she left the US
or does she has to apply for a student visa again ?

Any help would be great im without the love of my life for over a year now

How this bill is going to help F2B visa? it is not fair for a permanent resident to wait for there spouse for 4 plus years.

anyone please tell how H.R.3012 bill will help F2A visa category. spouse of a Greencard holder, permanent resident. i see everyone talks about all kinds of visas but no one talks about F2A visa. it is so sad that any visa category can bring there spouse immediately to USA only permanent resident has to wait for many years.

if this bill is not doing anything about that issue, i dont think it is a fair bill. but still i will support this for my fellow members.

f2AVisaVictim what about a bill for all H4 spouses? they are suffering more than you folks on F2A.
What about a bill for all undocumented? they need a bill more than F2A. Their problem is more than F2A.

Also can you enlighten me what you mean by you saying "i will support this for my fellow members". What kind of support are you telling us? Can you elaborate? saying on a forum that you support or oppose has no value. Also IV is a website. If you think F2A problem is huge, how many other F2A people are saying the same thing here? Can you do a poll and find out? It seems it is just your own individual problem and you want a private bill. Google it to find how you can get a private bill for yourself if you cannot even find 100 people here who think F2A is a serious problem.

H4 visa is not effecting anyones life. they can not work, atleast they can live with there spouse.

F2A have wait many years just to join there spouse.

for support question, please tell me how can i support. i am in INDIA waiting to join my spouse.
