Default Dual employment for 1 day on H1B

Hello, Please help me in following issue.

I am on H1B visa and joining the another company on 2nd July.

But my concern is my official last day in my current company is also 2nd July, I will be just on-call.

This means I will be employ for 1 day with both the comapnies (2nd July). I told this to my new company they dont have any problem.

Will this cause any issue in my status or later in GC process or in any other terms ?

Please help me friends.

Technically it is illegal talk to company B's attorney. you don't want to jeopardise your GC.

I did talk to attorney, she mentioned there is no clear information about this type scenerio. but she also mentioed it is matter of 1 day, and she handled lot of cases like this and never had issues also she added one more thing that if it is for long term then I-129 has to be filed as per "concurrent jobs", and this is not in my case.

I thought talking advise from expertise on immigrationvoice.org.

Technically one person can work with 3 companies with 8 hr of day on different H1s.


If it is same H1, it may be an issue but in most cases this should not be a problem.

Tell your old company NOT to pay you for the last day i.e you are on-call for free. This will eliminate any confusion.

Please don't take any chances with USCIS as it is always a 50-50 chance on how they interpret these things.
