H1B RFE related question

Hi All,

I need urgent help..if you can please reply that will be great help.

I am working on L2 EAD. My husband is on L1A and has filed for extension for extending the stay for those number of days when he was out of US (In India on vacation) out of 7 years of his L1A allowed period. His current L1A is expiring on August 6th and he has about 5 months of period when he was out of US out of those 7 years. I have filed for H1B but got RFE that they need to see a proof that I have valid visa from August 6th to October 1st (2 months).
Now the issue is my husband’s L1A got RFE (I am yet to get the query) but I am thinking it should be simple and hopefully I can respond and get it fixed (hopefully). But worst case I will not get L1A extended and may have to go back to India in August.

My question is if I respond to L1A RFE and in worst case L1A will get rejected and I will have to go India in August. Will my H1B get approved in that case?

Hi All,

Can someone please advice? Can you please help me with what should I do in this case when my husband's L1A got RFE and my H1 got RFE to show that I need to cover the period from August to October?

1. Should I respond L1A query and then wait for result to reply H1 query? Both my H1 and L1A ( husband's) are filed in premium. I have until July end to respond to H1 query.
2. Should I hold on responding L1 A query and still reply H1 saying I am waiting for L1 A as on RFE we can stay in US for some 200+ days and anyway effective October I am planning to go on H1? Will this work? Will it approve my H1?

Can you please help? I appreciate your time and help in this regards.
