Beyond six years HIB and one year outside USA

I spent close to six years on my HIB approved until Nov 2010 with some time unused . Now after spending more than a year outside US my new employer did a date recature of my old HIB unused and has got an approval until Jan 2013 from Jun 2012 . Also the new employer says that the only way i can get an extension is by the perm process etc and also cant file a new HIB now as the cap is over . Now is this is the right way or can i just file for extension and be subject to cap and even if they start the perm process now will they be succesful in getting an extension by dec 2012 .

please advise
