I am a H1-B visa holder from Maryland, me and wife separated but not legally, my wife being an H-4 moved out of my house and currently working under the table. She left our 3 kids with me and is not paying child support. Can i file for a child support from her, even though she has unverifiable income? would it jeopardize our status if they found out that shes working illegally? Can i make a request that she be sent back to my country? I dont want to give her a divorce because we got married in my country and there is no divorce in my country. Pls help, i need advice, she doesnt want to cooperate with the child support. Is there a way where I can just send her back to my country since she's not willing to help at all?

What are you trying to achieve by going after her who left 3 kids? Yes. You can inform authorities, if they find her working illegally they will deport her. Instead of being in a state of 'ran away from home', she would be in 'ran away from US'. It will jeopardize your chances of getting together in future.

If you can survive with 3 kids, just keep going without chasing her. For a H1-B, I know it is a more than difficult job. Buckle up yourself for the sake of your 3 kids, go home get help from parents/friends, lead a good life. In that case, check with an attorney if you are responsible for the ran away wife, follow his advice.

@ivgclive: i just want her to have some responsibilities, you cannot just bore 3 kids and left it with your spouse without any form of support or compensation...

Teaching her responsibility after she gave birth to 3 kids, would never work.

A H4 going out, working on her own, leaving 3 kids is hard to believe. It may not be appropriate to ask in a forum what triggered that event, where is she now, who is providing her support etc.,

Don't put the kids in danger by going after her in a remote country. It is important that you and your kids need to be in safe zone, before you think about next actions. When LAW takes custody of the kids, you lose them as well.

she's working in the DC area as a baby sitter/house keeper, shes renting a room in an apartment, she makes more than enough for herself, i guess what triggered it is wrong set of friends and influence.

Eventhough she has wrong set of friends and influence, it is not appropriate to let her working as house keeper for living. You are in H1B, speciality worker class, you know that this is not correct. Is this for what we brought them here?

If she is in a better level than you and because of that she threw you and kids out, it is a different story.

Restore PEACE for the sake of kids with the help of good friends. She will come back. Don't make it more complicated. At first, you find some real good friends and share your thoughts.

If you are alone and think, your mind only want to retaliate and never allow space for compromise.
