Default H1B revoked on CAP-GAP Extension.

Hello Everyone,

I graduated in May 2011, and I started working on OPT from July 6th 2011.

In May 2012 , I got hired by NY based company as a Software Engineer. They filed for my H1 in June 2012 and it got instantly approved.

My OPT ended on July 6th, 2012 and I was transferred to CAP-GAP extension, which expires on September 30th.

Things did go well with the company, and they let me go on July 27th. They gave it in writing that they are going to get my H1B revoked or withdrawn.

After speaking to a immigration lawyer and my school advisor, It is very clear that I can apply for OPT- Extension provided I get an offer from an e-verified company before September 30th.

Now, what they see as a problem is that if my H1B is not revoked before September 30th by my previous employer, then I might be in trouble and my OPT extension might not be valid. The company while terminating me gave it in writing that they would revoke it, but the lawyer say's sometimes the company might forget to do it and I just cannot do anything.

What do i do?

Default CONTINIUATION of the ABOVE problem

I'm asking everyone what do I do-

Because on Monday I have a Final Interview round with an X company.
What do i tell them?
Shall I request them to give me an offer letter with E-Verified number and file for OPT extension?
or Shall I request to File for transfer of H-1 keeping in mind my previous company has not revoked it or if its still under process?

Please Let me know if I'm not thinking right.
