Default H1 from new and GC from old employer

My client is ready to sponsor H1B and but its not ready to file GC. My question is can i keep renewing H1b with the I140 from old employer, if the GC process is kept alive from old employer.
i know that new employer has to file a new petition, but GC is for future employment and if i join my old employer after the GC that validates the future employment clause, right? so why does my new employer has to file a new petition for me, just an H1B would suffice and the renewals can be based on the I140 i have from old employer, isn't it? So just checking if anyone has answer for this.

The thing that worries me is stamping, since i am in E-V-C model and don't want to get stuck like few of my friends i know who are suffering. Don't want to jeopardize my kids life/schooling if i visit homeland for stamping.
