I am traveling from US to India and don't need a visa to India.
For the return part, I will have a valid US visa. My H1B visa stamping expired in September, though I also have a valid B1/B2 on my passport. I checked UK immigration and apparently they have new rules starting 12/13/2012. |

What is the new rule and where is it published ? The rules for DATV have been there since 2004 (or 2003 may be).
You need a valid Visa for US, Australia etc. if you are transiting through UK no matter which direction you are travelling. So , the mere fact that you do not need a visa for India does not exclude you from this requirement. On the brighter side, since you have a valid B Visa (I am guessing it is not expired yet) , you will NOT need a DATV. It does not matter what your status in US is or how you will be entering to US, all it matters is if you have a valid US visa . I have travelled on AP without having a valid H1 visa. However, I had a valid B1 visa (courtesy my earlier employer) in my passport and I did not need a DATV.
