Urgent status change?
I am currently under an H4 visa but I am turning 21 in one month and my visa expires April 16. I am 21 on the 17th. Born in Canada, I have been in the US for 17 years. Obviously this process of whatever I should have been doing should have been started months ago....It was not because I was told my status would be changed (being a dependent of my father's H1B visa our paperwork was in the process for greencard).... Now, with 1 month my parents have now told me I need to figure this out.
After lots of reading, I have come to the conclusion that a change of status to F-1 student visa is the only way…besides returning to Canada. In my reading though, I have also never heard of what my parent’s lawyers have advised them on me doing at this point: Go to my community college, meet with an international student advisor— explain my situation, and enroll in full time student status (12 credits). Then be over to the US border and change my status right there. They are convinced this is able to happen. How likely is this? Do I have any other options? Any feedback would be appreciated….Thanks!
