So.. yesterday I got the pink slip from my employer and I was let go.
I need help from experts to avoid making the situation from bad to worse 1. I have H1B and EAD. I was working with the company on H1B. Now the company gonna tell the USCIS about the lay off and revoke H1B. Does it impact me in anyway or GC application? 2. Do I have to inform anything to USCIS? 3. What do I have to do if I have to work on EAD. Looking forward the reply soon.. searching for the job as well.

My I-140 was approve long time back that too with a different employer. I think I am gonna join my old employer, with whom I filed for GC.

That's your solution - join the company which is carrying out your GC and nothing else needs to be done. That is the ideal situation for you to be in . Now just go out and get a job ( if you are going to be working as a consultant for your GC filing company) . Best of luck

I also Got laid off last Feb 19, 2009. Tried to look for Job. found 1 or 2 openings but hundreds of resume are flooding in. Chancei are very slim with all the competition out there.
Application info: Priority date: Sept 2006 I-485 pending- 1 year had passed. EAD valid for 2 years (Expiry Dec 2010). Im under EB3 category - Country Philippines: Travel State Bulletin Visa for April 2009 - Employment Base Category-- March 2003 USCIS- I-485 processing under Texas service center --July 2007 My Question is: How does the Travel state and USCIS processing differ from each other? I understand Travel state tells us if there are visas available and USCIS is about the processing of 485. Now, what happen if 485 reaches the date that USCIS recieves my application (August 2007. Current processing July 2007) .But there is no Visa available under travel state. (currently March 2003. My Priority Date is Sept 2006). Thanks for your input. |

Considering that USCIS is having the RFE fever now a days, it is best to stick with the employer who filed your GC.

I am in the same boat. I got laid off last month. I have applied to hundreds of positions but had no luck so far. My I-140 was approved in 2006 and I have a photocopy of it. I already started using my EAD last year. My question - if USCIS approves my green card in the meanwhile (slim chances), would that be a problem?....Also, if USCIS issues an RFE to check whose my employer, would that be a problem?

If they send green card interview then you can postpone it for 6 months and in the mean time you can get a job. But I do not know how to handle if they send RFE.
