Default Advice reg GC processing

Hi All,

I got my H1 approved in 2007 and I came to US on 2008. I have not yet applied for my GC processing as I do not want to do it from my current employer. My visa renewal is in Sept 2010. I am planning to get my H1 transferred in early 2010 and then start applying for the GC.

I dont hve anyone to advise me, if the decision I made is right or wrong. Can anyone please advise what they think,

You are making the right decision to start GC process only after finding the right employer. Look out for a good employer ( financially strong, employees are satisfied etc) and then start the GC process. GC journey is a long one especially for people from India/China etc.

The only downside is you may lose couple of months in terms of priority date.

In my view, if your current employer is ready to sponsor GC with out any contractual obligation then go ahead and start it. You still have option to jump to another employer and start with them again. You don't loose any thing and if in case you need to continue with current employer or some law changed or some miracle happened (like july 2007), you may get a chance to apply 485 also.

Default I am with rcr_bulk suggestion

specially with "Recapture of Visa" in mind. It might happen few years ( yes few years) down the line but if some miracle happens, you will get a chance to apply for I485.

Also if you are with current employer until you get ur labour and I140 cleared, Priority Date will be with you forever.

Thank you All for your advice. I am a little confused with the terms like Priority date, etc..
Is there any link where I can read more on the entire GC application process?

I would like to add to the above advice about Good employer that google the company name and find out is there anybody filed complaint about them in any of the websites or forums. There are so many forums and websites like Complaintsboard, desicruch etc.,etc., has information about bad employers.

Another thing to look out for is their adherence to immigration laws. Make sure the company follows immigration laws religiously and have good history with department of labor, uscis etc.
