I tried once for Dish Network and lost the case though I was right..
Reason,: too many things in the fine prints. Its their business and this way its tough to beat them. You may be really sharp to get around , I couldn't man.

I have successfully recovered monies from auto insurance company (i think it was state farm) for the accident in which the another car hit mine from back and then fled. Fortunately I took the car license plate number. The hit and run insurance company would not pay for the boots door damage. I went to local court, got the papers and called the insurance company asking where they would like the summon be sent. They settled and fixed my car.

Another was case involving Marriott Vacation Packages.

In fact, even if you sign a disclaimer when you visit doctor, it is more of a deterrent. You can still go and sue doctors in case of negligence because it is related to public issue and hence such disclaimers do not matter.

I am afraid you will be taking a big risk if you think like this and actually get into some issue (god forbid) without fully knowing what you are doing. The actual hospital will probably not go after anybody. However, after a few months - the bill gets sold for pennies to a dollar to the collection agencies - 99% of whom are pretty shady in nature.

If it is just a matter of 5-10k - then the collection agency will probably not go into too much trouble. However, if we are talking about 100k (or even 50k, very much possible for an extended hospital stay) - then you are a very short distance away from judgement and a debtors exam.

It is a different matter that the laws of the book place severe restraints on the collection agencies on what they can or can not do. If you know the laws (FDCPA, FCRA being the most relevant) - and can play them according to the law - then you will probably be safe even with a 100k hospital debt. But you'd definitely be pushing it against a properly motivated debt collector.
