My friend Cyrus Mehta reports on a disturbing incident that occurred last week at Newark's international airport. Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. Aside from being contrary to established procedures for revoking visas, CBP officers made inappropriate comments and issued threats that cry out for some form of disciplinary action by DHS: It is then no surprise that the outrageous singling out of Indians since the New Year waiting in the line at Newark and other airports by CBP...

Hello,
There is an official way to file a complaint against CBP individuals, see this link: https://help.cbp.gov/cgi-bin/customs...i=&p_topview=1 I request all affected to file the complaints here and request the revocation/reconsideration of their visas (especially if they have been subjected to deportation). |

We at the Murthy Law Firm will be contacting both AILA national and the CBP office in Newark and New York. Our effort is to gain clarification and determine the basis for sending H1B employees back to India (or other home countries), and, if this is due to an error of judgment or law, we will seek a reversal of this recent, alarming trend. In addition, a related January 8, 2010 memorandum from the USCIS analyzes the definition of "employer" and "employee" particularly for H1B employees working at third-party client sites. While these two actions may not be related, both demonstrate the current level of government scrutiny of the H1B program. Hence, each employer and employee should operate by strictly following the H1B program requirements. ©MurthyDotCom We will need to review the events and the USCIS's evolving definitions of relevant laws to determine short, intermediate, as well as long-term lawful solutions to deal with this issue. If an H1B employee accepts expedited removal / deportation (with the government paying the cost of the airline ticket) from the CBP officer, removal may result in a minimum 5-year bar on reentering the United States. I'm on H1, I decided recently to buy a house after I stayed more than 5 years in this country and gave an offer to purchase it . I will drop now as I'm feeling unsecured in this country of immigrants and with it's protectionist policy against Indian Talents in this 21st century. It will also influence all of my friends who are also potentially looking to buy houses . I will not buy any stuff and influence all of my friends which costs every H1 holder to lead uncertain state of living in this country.

I have sold a house in US while being physically in India. All you need to do is give a notarized affidavit to your Realtor and you don't need to be on the closing table. There is always a solution to worst case scenarios. Dude do some googling and you'll know what I am talking about.
