I came to India on Jun 12th for 4 weeks vacation with my family. Myself and my wife went for H1 & H4 stamping at Chennai consulate. Interviewer said I will get my passport with visa within 5 days, however I received an email saying that our visa's are under Administrative Processing (AP) and asked me to contact them after 90 days. We completed 82 days and still waiting for the visas. But the problem is my kids schools had been started from yesterday and they are missing the schools. Both my kids are US citizens. Is there is any way to request consulate or congess man to speed up our visa process? Any suggestion? Thanks.

My current H1 expires on 25th Sept 2011. My employer was late in filing an extension because of which it seems approval or any response would be obtained past that date.
Questions: 1. I have heard about the 240day legal stay in this country while extension is in process. Can I work during this period. 2. When I get my renewed I 797 will I get I 797A (with I-94) or I 797B (without I-94) when I get my renewal. Thanks.!! |

I have 2 questions:
1) Is there any grace period on filing LCA (for a new client location in a different state)? Is it ok to join a project say on September 15th 2011 and get a LCA certified from October 1 2011 onward? 2)Can a beneficiary get H1B extension beyond 6 years from Company B on the basis of approved I-140 from company A? I am currently in my 5th year of H1B (expiring Dec 2012). Now if I transfer my H1B to Company B in November..does my new H1B will have a different petition number? And can I also ask for the extension beyond 6 years during H1b transfer process? Thanks in advance to IV and to the respected Attorney. |

I am current after porting my EB3 priority date to EB2.
I applied I-485 for me and my wife in July 2007. Do I need do anything or Lawyer needs to do anything to get my GC? All I -485, I- 140 EB2 and EB3 Receipt numbers starts with SRC... It means my case is in Texas Service center? How much time will it take to get GC? Please suggest.

Hello,
Thank you IV and Prashanthi for this service... I am in the 8th year extn of H1b and i was getting yearly extensions based on my pending labor for last couple of years. And finally that old labor app was denied. My employer has submitted another PERM Labor application 1 month ago and it is still pending. My current H1b expires end of this month and it may not be possible to get approval on labor and 140 before the h1b expiry. So if i apply for Change of status to H4 or F1 to maintain the status and then my labor and 140 gets approved 2-3 months down the line... Can i still apply for H1b at that time based on 140 approval? In other words - My 8th year h1b expires this month end. I am planning to switch to H4 or F1 next week. IF my labor and 140 gets approved after i change to H4/F1 then can i get back on to H1b at that time? Thanks in advance. |

I am EB3 India with a 2003 PD. My I-140 was approved in 2006, and I-485 pending since 2007 but no longer with sponsoring employer.
I recently recieved an 'initial review" case notification on my -140, which is kind of strange since this was alreday approved 5 years ago. What could that mean? I called CIS over phone but they said they couldn't tell me anything on this matter, and the employer has to consent/be on the phone. confusing!! |
