Default Manager's Amendment Out: We Have Delivered Now it Is Your Turn

This post was written by the oh so eloquent Logiclife (who is on his way to the airport) I am posting it for him.

WE’VE DELIVERED, NOW IT’S YOUR TURN.

Manager’s Amendment: This is THE ONE.

Everyone:

Arlen Specter, the bill manager, will introduce few managers’ amendments. These are the amendments, we have been told, into which the Brownback amendments have been folded. 3 out of 4 provisions of Brownback’s amendments have made it into the Manager’s Amendment. The only provision that was not accepted was the provision whereby the 140,000 recaptured green cards were to stay only in EB1, EB2 and EB3 and not go to EB4 and EB5. However the other 3 provisions have been accepted and included into manager’s amendment. Those are:
  1. Lets everyone file 485, if their labor is approved even if their priority date is not current.
  2. Remove the hard limit on countries so that over-subscribed countries like India and China are allowed to use visa numbers that ARE NOT USED by other countries with low number of applicants. The hard limit was introduced by McCain Kennedy version of the bill. Today, the soft cap is in place and this provision continues the soft cap on countries in EB categories. This soft cap protects visa numbers from being wasted by their downward flow.
  3. STEM applicants would be allowed to be exempt from cap even if they have not been working in exactly the same discipline as their STEM master’s degree. This will be a huge relief for many in EB3 and majority of EB2 applicants as they would become exempt from cap.

Friends, we have delivered what we promised (except one provisions of recaptured visas). We got the Brownback Amendment introduced. We have those provisions in the Manager’s amendment, we are told.

This achieves the goal of IV, for the time being as far as Senate proceedings go. There is a lot more to do, as the House-Senate conference proceedings are going to be on final consequence to this bill. We have our work cut out in front of us

Now, its time for the OTHER group to deliver. Those members, volunteers and visitors, who have been putting off contributing funds thinking that “If Immigration Voice delivers results I promise I will contribute”. Its time to keep your promise. There are about 2800 members – registered members who have not contributed a dime. Majority of 1200 people who have contributed have done so MORE THAN ONCE.

So if you’ve been waiting for consequential output from IV before you would consider contributing then your wait time is over and its time to deliver on your promise. Promise to yourself and promise to your companions and friends on this website. Show us where you stand and show who you are – a promise keeper or a free-rider?

Thumbs up Congratulation to CORE

Point number 3 is a great one because the USCIS will not have the discretion to say that an applicant is working in his profession or not. I think this clause will free up a lot of numbers. Again the question is whether Bingaman's cap for family members will apply to the STEM+3 who will not be themselves subject to a cap. I'm not sure.

I want to add to what berkeleybee and ragz4u has said - we need to make sure you address this problem with your company. I and a few people in my company (I will not name the company but it is a company anyone will know if he works in computers) was able to get the highest authority in the company to come forward and espouse our noble cause. They are supporting Immigration voice in principle and through other contributions

We need more of this, we need support from the topmost management and we need it now more than ever to make sure the provisions stay in the final version - to name a few stalwart companies, where are the folks from Intel, Cisco, etc?


Can you guys please get over your fear and
1. Contribute to Immigration Voice
2. Talk to the seniormost HR, Govt. Affairs, and Legal folks in your company and work with them as representatives of Immigration voice.

Let the proud tradition of this country help you - you have freedom of speech, and it is legal to raise your concerns to anyone, what are you afraid of.

Be proactive now and enjoy the benefits for the rest of your life.

People, please support us. There is no reasons where you can say that IV can not do. Time has come that you join IV and contribute money.

Don't ignore the problem that you have. IV is working for everyone so come forward and contribute money.
