They are not keeping the same job. They have since found new jobs and applied through those companies. Technically the day you lose your job, you are out of status. Some stayed back a few months (I am assuming) and they were pardoned for this wrongdoing. By the way this is just what I picked from the rumor mill (you know the thousands of websites and forums out there ;-))

I know that time most of software guys tried to find suitable job and left this country (left their cars on air ports, as they dont want to spend $100 to tow their car!). I think more than 90% of guys from this Y2K/Dot Burst did left this country.
Basically, instead of we guessing on 245(i) candidates, We/IV should ask USCIS/DOL/Emilo Ghonsalves how they are arriving of "PD" by saying "Too much of VISA numbers (Backlog)" in Indis EB3 or EB2 category! Quote:

At one point concurrent filing of I140/485 was also absolutely impossible ...but then rules changed. Why not attempt for pushing 485 filing irrespective of priority dates be made possible.. I think this in USCIS control and so may not need Congress,law maker crowd to make this decision...again may be I am wrong assuming things. Please advise |

I really don't think number of Indians who stay back after dotcom burst is so huge, here are my reason,
during the dotcom burst, Indian job market was picking up and many of these guys were able to find decent jobs in India also do not assume all of the y2k guys were illitrate, atleast you need to have some degree to get H1B right I know some nuckle heads did leave everything and left but how many guys not in thousands DOS has about 300K and they claim out of which 75% are 245i and I really doubt India has lion share of this number |
