Well it all depends, If you are lucky you will get your GC as soon as the dates move pass your PD this year, I think VB dates for EB3 ROW will jump in the next 2 or 3 months (this is in keeping with the PD date movement in the last two years).
When this happens you will have a very short window, if you are lucky someone at USCIS willl pick up your case and approve if not you will have to wait for another year or so for the next oppertunity. I know this happend to two guys who were IV members last year they both had 2005 PDs and got their GCs within the first few weeks after their PD became current. Lately I have noticed quite a bit of EB3 approvals reported on certain visa approval sites. About 25% are actually with PD of 2005 (prior to May 1st ofcause). So there are two things that you have to pray for 1) PD become current and stay current for atleast 3 or 4 months 2) Your case is picked up for processing at USCIS during this time Last edited by RandyK; 02-13-2009 at 05:53 PM. |

I do think the dates will move but there are going to only a few get through the gate this visa year leaving many hanging on again till the dates open up again. My PD was current for more than half of this last year and had to watch people with priority dates in 2005 escaping before me. This is not unusual since the approval process is not a linear process where dates are concerned. |

Hi Everyone,
I am from India but applied under EB3-ROW. I have been a regular reader of this forum for the past few years but never really had anything as input as my case has gone through a lot of hassles. But on October 01, 2010 my case finally got approved after 6 years so would like to share my bit of information as to how you can get things rolling if they seem to be stuck at USCIS. 1) Make sure the application did get tagged as ROW and not India. 2) Most importantly get in touch with your Senator's office. My senator's office finally got me greened They will go out of their way to help you period. My I 485 application in spite of being applied under ROW was being treated as India despite rectifying this with repeated SR's. When the Senator's representative called USCIS they still had it under India! The representative made sure this time it was fixed for good.They even got USCIS to send us a FP notices as our's had expired. USCIS did not bother to send us a FP notice even when our cases were pre-adjudicated. Here are our case details: EB3-ROW PD: May 2004 I-140/I-485 Concurrent --> RD: 29 June 2005 I-140 AD: 29 Aug 2005 3 EAD's applied. I-485 AD: 01 Oct 2010 ![]() Hope this helps those who are wondering why their cases are still pending in spite of being current. |

For people who might be wondering how a person from India applied under ROW.
Sorry I should have mentioned this in my earlier post. My wife is a UK citizen by birth hence I could apply under ROW using my wife's country of birth. EB3-ROW PD: May 2004 I-140/I-485 Concurrent --> RD: 29 June 2005 I-140 AD: 29 Aug 2005 3 EAD's applied. I-485 AD: 01 Oct 2010 ![]() Good luck to all those who are pending. Before my priority date( sept 2005) there are 8,000.....so hopefully will be current sometime next year. Experts can you please shed some light on my calculations? Thnx in advance!
