Hi all,
My country of birth is China (retrogressive), my husband is Philippines (current). I would like to apply EB2 as primary applicant (my husband as my dependent), cross charge to my husband's country of birth, and apply I-140 and I-485 concurrently.

Is cross charge do-able in my case?

I spoke to a few lawyers, one said I cannot use it because I am not the one accompanying my husband, and others said I can.

Any help and input are appreciated!

Yes. It's definitely do-able and encouraged to get your green card quicker.
