My wife's lawyers replied to the PERM audit on June 12th. We are still waiting to hear about her PERM Labor application with a priority date of Jan 20th. Any others out there whose PERM was audited and still waiting to hear with a priority date in Jan 2012 ????

Your processing time seems ok to me.
Check - Welcome to the iCERT Portal The perm processing time for audits is Jan 2012 as of this writing.... so you should be just around the corner. Good luck!

Anybody else out there who has a Jan 2012 priority date and got audited and still waiting to hear the PERM decision ???
This PERM wait is getting to be excruciating

how does USCIS know that this is a porting case from EB3 to EB2? The porting is done only at I-140 stage. Ofcourse they can see the PERM and infer that it is going to be a porting..for example if your wife has 5+ years experience in the same company the only way she will be on H1 inside US is if she is in backlog. But inferring that someone is going to port the priority date in the future during I-140 is not a ground for audit. In fact, the porting and PERM are done by 2 separate departments within the govt. Porting is done by USCIS while PERM is done by DOL.

Over 1 year and still waiting for PERM Labor
My wife's PERM application was filed on Jan 20, 2012 and audited in May 2012. Lawyers responded in June 2012 and till today there is no word on her application status.
Does anybody know what is it that we can do? Should I contact my Senator's office - does that help in these cases?

In general most of the PERM audit case denied .(It will take lot of time) Hope for the best and prepare for the worst if you need to....
