hello everyone,

I am filing for my 485 this month. I had asked my lawyer to apply for ead/advance parole also but she replied me back saying that since my h1 is till 2010 I dont need to apply for them as I can work and travel on h1 while my gc is in process. She says if I want my wife can apply for them since she is in h4. Can any one address the pros and cons of applying for ead/ap or guide me to any other post which discuss this. please respond urgently as I need to make a decision regarding this before they apply for 485. Thanks.

Your lawyer is misguiding you. Apply for EAD and AP. You cannot have the same flexibility on H-1 vis-a-vis job change and travel.

since you can apply for ead and still use your h1 go for it.

i dont think your lawyer is misguiding you.. i think, he must have told you, if you dont intent to change jobs now and if you are pretty secure in your job now, then there is no point in applyn for EAD now. You can apply for EAD anytime you want. Thats what my attorney told me too.. What is wrong in his suggestion..??

If you are sure that you do not need to change your jobs (whatever reason), than I guess it is fine.

Thanks for the response. Can I file EAD my self at a later date so that I dont need to confront/explain my argument to attorney and once I get my ead can I choose not to use ead/ap for work/travel and use my h1 instead.

yes you can. There is nothing wrong in explaining your arguments to your attorney..Afterall he your attorney and is working for you.. Mine welcomes arguments and then squashes it in 10 minutes

Do you want to go for H-1 stamping after each time you renew/extend it. Personally I would take the EAD/AP route.
