There are still a lot of cases in labor backlog with pre-2002 cases that have not yet been cleared, june/july there were thousands of cases approved for people uptil 2005. so what will happen, will in october the dates go to - "say 01AUG03", is this what you are expecting .... I am totally mystified by your pre2003 assumption and would love to get some more info on how that date was derived. |

you sir, certainly are not as smart to file in EB1. more ever its not about being clever it can sometimes also be a company policy, the exp, the qualification. There are plenty to shops that do not entertain EB2. EB2 or EB3 hardly makes a difference at professional level. Its only a counter in GC.
Once this is all over, an EB2 case just might be reporting to an EB3 Manager. Please do not post comments like this, everyone is in this for a cause, You did not make a first impression as a concerned member of IV and since you are here the cleverness is itself proven. |

EB3 - India PD 1/03 I140 approved - march, 2006. 485 status - Rotting in NSC with a single RFE Lost H1, working on EAD. Invoked AC21 twice. Attended DC Rally and contributed to IV many times. Renewed EAD 3 times and AP 4 times Total cost from the H1 days (new h1, extension, ead, ap, 140, 485 etc - $22000) Total cost if I had bought a labor certification those days and having a GC by now - $15000 Not knowing if GC is this worth - Priceless. R2I'd in Feb 2011. |

hi everyone,
I want to get feedback about the possibility of pursuing PERM for EB2 and still capture my PD for EB3. Here is my situation. I am a South Korean with PD in Dec. 04 on EB3. I filed I-485 along with EAD & AP on 7/25/07. I recently got a master's degree in another field, and my current job can hire me in a different position. Q1. If I ask my employer to file PERM on EB2 for the new position requiring the master's degree, I should be able to capture the PD (12/04) for my EB3, right? Q2. Based on the september visa bulletin, should I wait on the EB-3 AOD application to be processed or would it be faster to switch to EB-2 and refile I-485? Please explain why. Thanks.

I guess this simply the demand supply equation. I might in realty be the other way with regards to the number of EB-3 approvals. I remember reading that EB-3 India got quite a few visas in June and July of this year. I dont remember the exact numbers but I am sure they exceeded the 7% per country limit. Anyone remember the exact number of approvals for EB-3 India
