How do you know if your namecheck is done or not? Can you just call USCIS and ask???

There is no injustice in the VB...just a higher demand from EB3.

If there is any injustice then it is with the present per country limits without regard to the demand and skills that emanate from a country.

EB ROW, please be patient it will be all yours after Oct. 2007 for the next 9 months.

What makes you decide on the pre-2003 PD. why should they be out of hibernation yet. As fas as I have seen May EB3 india was May 2001, we all know what happened since then. There are still a lot of cases in labor backlog with pre-2002 cases that have not yet been cleared, june/july there were thousands of cases approved for people uptil 2005. so what will happen, will in october the dates go to - "say 01AUG03", is this what you are expecting ....

I am totally mystified by your pre2003 assumption and would love to get some more info on how that date was derived.

you sir, certainly are not as smart to file in EB1. more ever its not about being clever it can sometimes also be a company policy, the exp, the qualification. There are plenty to shops that do not entertain EB2. EB2 or EB3 hardly makes a difference at professional level. Its only a counter in GC.

Once this is all over, an EB2 case just might be reporting to an EB3 Manager.

Please do not post comments like this, everyone is in this for a cause, You did not make a first impression as a concerned member of IV and since you are here the cleverness is itself proven.

Question swtiching from EB3 to EB2?

hi everyone,
I want to get feedback about the possibility of pursuing PERM for EB2 and still capture my PD for EB3. Here is my situation.

I am a South Korean with PD in Dec. 04 on EB3. I filed I-485 along with EAD & AP on 7/25/07.
I recently got a master's degree in another field, and my current job can hire me in a different position.

Q1. If I ask my employer to file PERM on EB2 for the new position requiring the master's degree, I should be able to capture the PD (12/04) for my EB3, right?

Q2. Based on the september visa bulletin, should I wait on the EB-3 AOD application to be processed or would it be faster to switch to EB-2 and refile I-485? Please explain why.

I guess this simply the demand supply equation. I might in realty be the other way with regards to the number of EB-3 approvals. I remember reading that EB-3 India got quite a few visas in June and July of this year. I dont remember the exact numbers but I am sure they exceeded the 7% per country limit. Anyone remember the exact number of approvals for EB-3 India
