Default needs to travel after FP

I applied for 485/EAD/AP in the month of June'2007.
I got the receipt and my finger printing is done.
Now my EAD/AP?485 are in pending approval stage.

At this time, I need to travel out of country for urgent reasons,

how it will work.

I have H1B stamped on my passport which is valid till March'2010.

Is it OK to travel on this H1B and re-enter or as my finger printing is done, I am already on AOS status.
My I-94 would be different after coming to US again what I submitted for 485

Am I supposed to tell something to Immigration officer while re-entering

Please help.

That's a very good question as i am in a similar but not exact situation. Maybe senior members have faced this and can give us some insight into this.

FP is just another formality in the whole process, you will be on H1 as long as you fulfill the conditions for it.

So you can reenter using H1.

Yes, it should be OK. I went to India, got H1 stamped, with pending AOS. That was in 2005 though. So check with more people

I am sorry to say this but the same questions have been often repeated in this forum and answers given. If you spend a few minutes searching you can find answers to all your questions. By opening new threads for everything we are just cluttering this forum.

anyway , answer to your question is 'YES' since you have valid visa then you can re-enter to country based on the visa. If your visa has expired you can get a visa stamp for the remainder of the H1 period in your home country and enter back using the VISA.
