No EAD is required, only I485 receipt is good.

Also, you can get DL with H1b receipt for 1 yr from the date in receipt.

Another point is, first they use to collect the document then send them to Richmond for verification. Once its verified they would call you for the photo and license, it was taking 2 weeks. But now they do immediate verification with Richmond and give the DL, provided you go to DMV on a regular week day.

We went to Fair Oaks mall DMV.

If you have H1B notice, you can try that (I am not sure).

Hope it helps. Good Luck!

With the original I-485 receipt notice, my wife was able to renew her DL, but only 1 year from the receipt date, which is in Feb 2012, so in less than 6 months, she needs to go back and have it renewed again.

The problem is by then it will pass the 1 year mark from the original receipt date, I am sure we're not the only ones who are in the boat? How does everybody get it solved? I asked the manager the question today, but she basically told me they will fax the doc to the headquarter and let them decide. I asked further when we can come back to start the process, she said in January, I asked why in January, why can't we start the investigation now, then she started saying that I didn't get what she said etc. It's really funny to hear that from someone whose IQ may be not even half of mine, hahaha.

Default VA License

I dont know why they gave 1 yr from receipt date. They normally give one year from the day you renewed. Receipt date doesnt matter. My wife was renewing past few years with our 485 receipt from 2007.

I far as I know, you need to have the following for VA license.(I assume that you are not a US citizen or GC holder)

1) VA address proof (like lease and/or bank statements)
2) H1B approval or I-485 receipt notice. (H1B receipt notice might also work)
3) Passport and another identity like SSN card.

Your CA expired license might help.

For the people with I-485 receipt they give one year DL. In this case, they used to take few weeks for the verification of the documents by sending them to Richmond. Now they verify immediately and issue DL. If you go on Saturdays, they will not be able to verify the docs, you have to go again on a weekday.

anyway please check the DMV site Commonwealth of Virginia Department of Motor Vehicles

Good Luck and Welcome to Virginia.
