Default Can I change my job?

Hi All,

Approval for my I-140 has recently come in DEC 2007. I-485 filed in July 2007. Got EAD, AP approval. I need to check if I need to wait for 6 months after 140 approval for changing my job?

Its 180 days after you file for your 485, is not related to the approval date of 140.

mugwump: Thats not true. While AC21 applies from 180 days after the I-485 receipt date, the I-140 should be approved or approvable.

Hello Green: You can change jobs 180 days after your I-485 receipt date.

sorry, should have worded it more appropriately.
In this case, the guy has his 140 approved, and his question was if he needed to wait for 6 months after 140 approval before he could change his job. the answer to that is no, ability to change jobs is not related to the approval date of 140.

If you switch to EAD, you give up your H1B status. You would need to go out of the country to come back on H1B (assuming you have time left on H1B). It would be treated as a new H1B application, and you would not be "maintaining your H1B status"

I am guesing that in 2001, you were doing an H1 transfer where it is possible to maintain multiple H1Bs.

Can you tell me when you filed your I-140 and which state? I filed my I-140/485 concurrently on July 1st and my I-140 is still not approved.
