EAD...job crisis

Currently, i'm having some problem with my current employer. My i-140 is appproved and 485 had been filled over an year. What are my options?

also i'm planning to open a business?

what is better to get the Corporation ? or the LLC?

what are the advantages and the disadvantages.....

change employers? Since your I-140 is approved, you can change employers and continue the GC (AC-21 portability to a same/similar position)

porting to self is an option, but its dicey and you will have to defend in case you end up in an interview. Easier option is to do business on the side on EAD, while working for some other employer (so asfar as USCIS goes you give them theemployement letter from that employer and your GC is based off that employer). make sure your business is not something in which you compete with the employer

LLC is a pass through entity. Cheaper to manage, doesnt need to pay corporate tax. For a small business LLC might be fine.

Do you have risk of I140 being revoked? If so, AFAIK, first import thing is AC-21. This may create a need to find an employer, do the needful.

If you have no risk, you can techically have business, but if you are primary applicant, you should be in own area. For example an IT primary applicant can have problems with plumbing business.

And at the time of I485 adjucation, you need a job offer based on I410.
