Default EB2 India with PD current - AC21/EAD Cases

Congrats to all who got their GC approved. Good luck to everyone including me who is still waiting. Hope we reach the end of the tunnel soon.

This is my situation...

I was laid off back in 2009, and my ex-employer notified USCIS that I'm no longer with them despite requesting not to do so. I received an RFE for EVL few months later, for which I've timely responded. Also, I had to move out of state for my new job, so I ended up changing my address, that triggered an FP (only for primary applicant).

I'm seeing a trend that people who are in similar situation are not getting approval on time, or at least without further effort. Correct me If I'm wrong.

I know there is a whole lot of people who invoked AC21 during recession or forced to use EAD. If anybody in similar situation got their GC approved without issues or if you are still waiting for approval due to the above said reason, please post your comments here.

I would really appreciate your input.

Default Still Waiting...

I am almost in the similar boat, except that my previous employer did not inform uscis(my previous start up closed during the end of 2008). I have invoked ac21 with the new company and I am still on H1 with the new company. my pd is oct 23rd 2006, rd is july 2nd 2007, TSC.still waiting.

Did not receive any RFE as of now, I have already submitted an ac21 and the new job's role is almost same even in the H1 petition, so I wouldn't expect a RFE .

FYI: few of my other colleagues who were in my previous start-up did get their gc without any RFE, I know that they have not submitted ac21 either.

I have similar case. I got greened today with no issues. I changed job using AC21 on EAD. I do not know whether my employer cancelled my I140 or not. But I got GC with no RFE. I never opened SR or never went for an infopass.

AC21 cases with no RFE seems to be okay. In my case I received RFE after job change and FP for address change.

My attorney advised to wait till next week.

It seems to me that straight forward cases are getting precedence over the ones that received RFE in the past, or maybe the applications are approved in the order in which they were pre-adjudicated. Moreover, my case was transfered from CSC (Receipt #: WAC####) to TSC, and I don't know if that has anything to do with the delay.

I knew that the entire process is a nightmare and it will not end without a chaos. My attorney says I need patience, but it's easy said than done. Because he/she is not the one who spent the time, money and going through this hardship.

Good luck to folks in the waiting list.

Default Post Decision Activity - Approved - No Card Yet

Our case was approved on July 11th from TSC, but no CPO or Welcome email yet. Customer support does not have any information on when the card will be ordered.

I did some research, and there are so many people in a similar situation, who did not receive CPO email but got FP notice in mail. In some cases the online status went back to Initial Review when FP is done, and in other cases they received CPO email after FP.

In fact the approval notice says that we may receive an FP notice, but not everybody gets it. Does this only happen for people who moved recently or used AC21?

Folks in similar situation please post your experience and let us know if you finally received the card or not.
