Default Interfiled, EB3 to EB2 , priority date current...updates

Dear Friends,
Please advise me..

I interfiled from EB3 to EB2 ..priority date us may 2004 which is current in EB2. IT has been close to 6 weeks. 2 weeks back we contacted our local senator, who inturn updated us that they spoke to USCIS and they will intiate a new finger print notice. We did nto get it till date. I have plans to go to India in couple of weeks for my Brother's wedding.

What do you suggest we do now? How many days does it normally take for FP notice to come.

I was thinking of taking a infopass to see if they issued any FP on my case..the rep was ready to open SR but the database was down and she asked me to call later.

Can anyone suggest which would be more helpful SR or infopass...any inputs will be greatly appreciated.

It has been a long wait of 11 yrs and i hope we get it soon.

For this FY they have run out of visa numbers as of Sep 15th . There won't be any approvals until Oct 1st if I assume correctly. You might get your GC in Oct. You can use AP for travel since you will be able to get back even if your GC is approved.

I am more concerned on how long will it take for the FP notices to come in. Its already been 10 days since they processed. I dont want to miss the notice and travel and create whole new issues.

Please suggest any inputs.

If you don’t want to miss the notice… simple answer is …Cancel your TRIP. Other option is schedule the travel as close as possible to your brother’s wedding date. Ask your dear ones to check your mail box every day. Once you get your FP notice, immediately fly back to US.

You can reach within 24-48 hours. This is not a big deal. Still you feel some jeopardize, cancel your trip and cross your figures.

If you pay 8000 to 10000 rupees, You can watch your brother wedding live from here.

Your attorney will also get a courtesy copy. Ask him to email you scanned copy of appointment while you are in India. You can always reschedule your biometric appointment by calling the 1800..... number on the appointment notice.

Make some arrangement to recive your mails. As soon as finger print notice comes in call and request them to reschedule it for later date.

My brother was in exact situation, he called the TSC and they sent the I-797 for finger printing to the nearest finger printing center. He got his FP done the next day and with in 4 days had the case approved.

His wife, who is a beneficiary, her case is still pending...not sure if they ran out of visas or her back ground check but she is still waiting.
