Priority Date EB2-EB3

My eb2 labor priority date aug2010 and eb3 jan2010 and my 140s are approved for eb2 and eb3. I asked my lawyer can I file I 485 he said we can file now. I want to make sure can I file now I485 with my eb3 labor priority date.
As per present speed next month priority date will move from jan2010 to jan2011 so my eb2 priority date will under.
Please let me know is this option we have or rule is defined in somewhere to file my I485 if eb2 and eb3 are approved which is the lowest date.

Yes you can file AOS when EB3 priority date is current.
