Unhappy Should I change my lawyer

My I140 has been filed recently. My H1B 6 years expires in Oct 2012.

Our current lawyer has been company appointed. We are covered till the I140 filing stage. the payment for the next stages has to be borne by me.
The lawyer is very conservative and takes a lot of time to file. he delayed our perm filing by about 3-4 months. For I140 he is advising us against the premium processing. says that normal should be sufficient.
Given the way that the current movement is occurring on the EB2 side, we do not want to miss the boat if the dates become current.

I have 3 questions:
Should we change our lawyer now?
Can we change our lawyer now, at this point when teh I140 has been applied(it was applied last week)?
Should we go for premium processing?

Your questions become subjective, and i can only answer them in my view point. Also i am not an attorney to suggest.

1. Should we change our lawyer now? — No Need ..go with this attorney as he is doing due diligence before taking any step. delay does not mean that he is doing intentionally just for you.

2. Can we change our lawyer now, at this point when teh I140 has been applied(it was applied last week)? — as per PERM and I140 is concerned they are your employers petitions and not yours- hence employer hires the attorney. Hence your employer has to agree to the change and when your employer has a new attorney you they need to file a new G28. But i would suggest to wait and if you do not like this attorney to file your I485 which is your petition and has nothing to do with the employer you can then choose the attorney of your choice.

3. Should we go for premium processing? -The attorney was right, there is no need of it. You will not miss the boat b'cos you can file I485 even when your I140 is pending approval.

Ans: Depends. If your employer agrees for premium & you don't care for my money, Ask lawyer do upgrade to premium immendiately.If he does not oblige then change lawyer.

Can we change our lawyer now, at this point when teh I140 has been applied(it was applied last week)?
Ans: You can change lawyer at any time.

Should we go for premium processing?
Ans: If you don't care for money. Premium is the Best thing.

More than all Peace of mind.

Keep in mind I-140 regular processing has slowed down considerably these days & Oct 2012 is not far away.
