Default RFE 485 EB2 PD June 2009

Hello,
I was emailed by my lawyer that there is an RFE on my 485. We dont know the reason as we havent recd the mail. My PD is June 2009 EB2. So I was under the impression that nothing will happen until October 2012. My lawyer says uscis will preapprove and not give GC untill PD is current. She maybe right but I dont trust her. It would be nice if someone could explain this. I have got my EAD/AP earlier this year.

Also another question is that my lawyer wants me to get my H1b Stamped when I go to India in December 2012 even though I have my EAD/AP. I really dont want to go through the hassle unless really required. I have a stable well paying job and dont plan to jobs anytime soon. What do the pros recommend.

I know many of you might say that listen to your lawyer, but in my experience she is a moron. If it was upto her I would never get my GC.

Reg your RFE it is a usual process and nothing to be concerned about. Most likely the birth certificate/marriage cert/immunization etc etc. Whatever it is complete the required steps when you get the official letter. Most likely it will go to the attorney. Keep asking her whether she got it. You might have atleast 3 months to reply but try to get it done before whatever deadline is indicated on the rfe letter. Basic point is this is usual procedure and nothing to worry about. When you get the rfe post it here and we can certainly provide you info on how we all handled these.

If you have the I-485 receipt number, check online status of your case here https://egov.uscis.gov/cris/Dashboard.do

Usually it takes 3 weeks to receive the copy of RFE after the online status changed to RFE status. If you haven't received your copy , make sure to get a copy of the rfe to see what are all the additional documents required by the uscis and also make sure the attorney sends the reply in time to avoid potential denial of the original petition.

Try to keep in touch with the attorney until you see RFE response review status in the online my case status page.

Not a pro...but IMO EAD & AP should be fine. But, you should also consider the transit visa issues while travelling on AP enforced by some countries...so a stamped H1B on the passport may make travelling easy.

RFE - Request For Evidence, thats all. They need few more papers, photos, etc and you have to send them within 60 to 80 days as mentioned in the letter.

There is absolutely no reason to pump the blood pressure to critical levels.

Do read about 221g before you go for stamping. Are you a scientist?
There are other questions to be considered - why do you need an h1b when you already have EAD and AP ? Is there any extra lawyer fees you or your employer are paying for H1b? Is there any expense in stamping and courier mail services? How is H1b really beneficial for you ? What are the risks ? What are the benefits ? Have you got your answers in writing from your attorney?

I have seen people using AP without going for stamping and still keeping valid H1B. So I would recommend you stay away from stamping. If you have an issue with transit visa then f*** those airlines/countries and chose different routes. They are the losers not you.

Default RFE and Stamping

RFE is a process of asking additional information. They had asked me to furnish my X ray report. Nothing to worry about
Your lawyer is right when she says that they will adjucate your case and will issue
you your card when the PD is current. This was the case for many people who filed for 485in July 2007.

Stamping is not necessary my friend. I used my AP to travel outside the country even changed my employer and used AP and EAD.

Do not get into the hassle of getting your H1B Stamped it is not worth it.
