I-485 Interview / Reckless Driving

I got arrested for DUI charge back in June 2010, got bailed out, and hired a lawyer. During the court process, we were able to reduce the charge to Reckless driving.

Now related to Immigration, I am waiting for my I-485 (EB3 - India) to be approved. My priority date is July 2003. I have no other criminal record other than this Reckless Driving.

My wife does not aware any of this. I decided not to tell her because it will create big problem in our marriage life. We both received I-485 Interview letter. 10.15 AM for me and 11.00 AM for my wife on same day. Since the interview timing is different, will they asking her about my criminal record. Should I tell her everything?

P.S: USCIS issued REF 2 months back on this offense and I submitted all court documents already.

Does anyone gone through this before? Any input will be greatly appreciated.

Even though you and your wife have different timings....you will be called together. No point hiding anything from your wife...at least at this stage!

Just curious... Your PD is July 2003 and the Cut off date is still hanging around 2002 Nov. Do you still get interview?

I have same issue 4 years ago, after this accident u ever go out side of US? if u go any issue in entry? my pd date 2009 i don't know when my date is current, let me know asap so people help in future. after interview put your exp.

I went outside the country and came back with no questions asked at the POE. Yes, I will post my interview experience once it is done.

Thanx for responce, one more think i discuss with attorney when this issue happen with me and he says one misdemeanor charge not effect on your immigration process, more than one misdemeanor or fellony charged effect in process.
one more think I-485 form, asking about arrest record u say yes or no?

I answered no since I have filed my 485 before this incident happend.

I was in similar situation. I had a misdemeanor (giving alcohol to under 21) after I filed I-485. I never bothered to update 485 since it was already filed. I was called for an interview and the officer went over all the questions again. When he asked "If i was charged" I said Yes and gave him the docs that showed that there was no arrest and case was dismissed by state. six months later I was current and got my GC. Also, the office interviewed me and my wife seperately

Did they discuss about your misdemeanor charge with your wife?

A side question - Can the interview happen even before the PD is current? I see the PD is July 2003 (EB3 - I).. The current Date is Nov 2002..

I have 2 young kids, do they allow kids with you during the interview?

i had a dui and interview for i-485.

No questions were asked about dui and the interview lasted less than 10 minutes.

driving at 74 at 55 miles is reckless driving.... many... rather a lot of people get such tickets everyday...... it doesnt make them bad or immoral person..... it just is 1 thing on ur record.... if it were to show u on ur record the 2nd time... then it could imply that ur a habbitual offender..... other than that.... that should not be a problem with uscis....

but u got bigger problems.... u ve not told this to ur home minister.... oh boy..... thats trouble written all over it my friend.....
