Hi,
Can any one let me know how much time does USCIS give us to answer a query on H1B.

I got a query on H1 in mid May.

I am not able to catch hold of my attorney to check whether he has answered the query.

Generally they will give 90 days.

it depends on the type of query. I think there was a USCIS memo that went into effect in June that addressed this. I don't have the link but I believe the maximum period to respond to a RFE is 84 days.

Default RFE Response Time

My brother had the same issue and I approached my immigration attorney. She said, USCIS usually allows 3 months which is more or less 90 days to respond to an RFE. If we fail to respond even after 90 days, US bars people entering for 3 years. Hope this helps.

Can you please post source of information? Why would USCIS bar people from entering US if the employer did not respond to the RFE? It could be anyone's mistake for not replying to the RFE. Why should the benificary (who has no control over the H1B process) be barred from entering the US?

What you said was wrong. I am a living example for that. In 2003 a stupid consulting firm applied for my H1b. They got an RFE(I dont know what was it about). They did not answer the RFE and I dont know what happened later. I stayed on my H4. This year I applied for H1b through a very good firm but a start up and got approval also.

If the RFE was not replied the case is considered as abandoned by USCIS.
