Default Applying for H1B under Masters Quota of 20K

Hello Gurus,

My Friend is a Master's student currently working on OPT. His OPT expires early next year. His Master's thesis is yet to be presented for the completion of degree. All his other coursework is complete. Is there a chance that he can apply under the Master's quota in such a case or does he need to have his actual degree certificate in hand?

No, he needs to have completed all academic requirements for the degree. I was in a similar situation; my company ended up applying under the normal category (luckily the cap hadnt been reached yet).

Thanks for your reply Dixie. Unfortunately due the negligence of the consulting firm( whats new heh) he missed the cutoff by 3 days. My friend did hear from one of consultancy about getting an email from Dean/Advisor about the possible completion of the course soon. ANy thoughts?

The only document that the USCIS will accept is a letter from the university administration saying XXX has completed all academic requirements and will receive the degree on date YYY. I doubt "possibility of completing soon" will cut it. It is one of those matters that is upto USCIS discretion, and in most cases (again, what is new ?) they will follow the strictest interpretation possible.

Default What is the Master's quota?

I have a PhD in biosciences from a US University and I have been working for the last couple of years. I was hoping to get a national interest waiver and apply for a GC instead of going through my employer but my lawyer told me that I did not qualify and had to go for an employment based green card only.

Was he right? Or can I apply for a national interest waiver and not be tied to my current employer?
