H-1b approval after termination

Hello.



My opt started January 15,2009.



I got a job and my employer filed H-1b visa on April, 2009.



I was terminated in May 2009.



I got an another job with new employer. Worked through June,2009 to December 2009.



I thought I was still F-1 status and I was on OPT grace Period. (My opt ends January 14, 2010.)



On the process of changing my status to F-2, I found out my F-1 was completed on October 1, 2009.



My H-1b application was actually approved on August 2009(it's after my termination). That's why my F-1 status is completed.



But the attorney of former employer did not notify me my case's approved until yesterday.



My former employers did not withdraw my application and also did not report my termination to USCIS.



My status on USCIS website is still RFE.



Since USCIS thinks I'm on H-1b status but I'm not working for the employer anymore, I'm out of status now.

Is there any way that I can retrieve my F-1 status back or change my status to F-2?
