Can we Withdraw MTR to AAO?

My H1 got denied this year and I am planing to do apeal with Motion to Reopen.

My questions are:

1. How Long it takes to get result of apeal?
2. If the apeal result is pending next year, can I apply for new H1 visa for next year quota in April 2008?
3. If I plan to withdraw the apeal next year, can I do that? And How?

Please some one help me answering the questions. Time is going fast for me.
