Default Employer Fraud.

Hi all,

I don't want to type a long story here telling all my ex-employer frauds and their policies. I pretty much know that I am victim. All I am asking me is to please provide me with the details of the officials i can approach to report the fraud( I wasn't paid 15 days salary though I worked on those days). They are simply refusing to provide me with the final paycheck though I gave the month notice that is required before resigning. Can I report to USCIS officials regarding this fraud? Can I sue them?

Thumbs up Yes

Yes, you can. As long as you worked legally for your employer, you have nothing to worry. Never leave such idiots alone, go ahead and file a case or sue them.

Talk to an attorney for the options you have!

Good luck!

Default Employer Fraud

Depending upon state you live in like Maryland, you can actually claim 3 time of wages due from your employer. You can simply file claim with state of MD. I am sure same rules apply to other states.

You can also file complaint with Department of Justice, Civil rights division. They investigate complaints like these.

Thank you very much guys. I reported them to the Department of Labor. I actually called them based on the phones number that were given their website. My ex-employer is in NY. I called the Buffalo department of labor(federal). She took all my details and ex-employer details. She said that she will follow up with them and ask them to send the check. Meanwhile, I will try to approach the NY state department of labor.

Yes, I worked for them legally (H1B and all). They are simply pissed because I left them. I worked for these crooks for 3 years. In spite of that, they are harassing me. I am not getting the July paycheck. It's been 2 months and they are refusing to pay me.

The employer is extremely shrewd. They have fraudulent policies and procedures. They said that they are not required to provide me an experience letter. They will take 3 months to provide you with your 1 month salary. They took a sweet 60 days to provide me the last but one paycheck(I called them for that like 100 times). Now, they simply don't send my last paycheck. Please refuse to deal with them at any cost like vermin they are...

Did you sign any contract agreement with your employer....If yes and your current job violates the contract agreement...then its kind of difficult....

If you didn't sign the contract agreement...then do the following...

Send the registered/Signed mail to your employer address requesting [Not ordering] for the salary he failed to give...
Make 3 such mails...and then file a case.....you got a strong chance if he didn't reply....

My advice would be speak with your employer in a polite way[Obviously he won't lift the phone]...get the money....
