Default H1B + Work for foreign company?

Hi

I am on H1B now. Can I become an employee of a company based and operating from UK and work remotely? They do not mind me working remotely as it is a software development position. Is there any paperwork involved that needs to be completed before I can accept the position. Are there any legal implications with my current H1-B status?

I can tell you that H1B is only for US employers, In other words the company will need to get incorporated here, register, and open an office.

Your H-1B should not be impacted as you are not taking the job of an American . Just kidding.

Assuming that this is valid, the impact will be on getting a W-2 for the remote job offer. How will you file tax returns? Definitely not in UK and it should be in USA. Is there any IRS provision that lets you show this as income from a foreign job?

I thought IRS requires everyone to file "worldwide income", so long as you are present in the US for at least 180 days in the year.

The location of the employer does not matter. If you are located in the US, you require an H1B for the job. What you described is unauthorized employment.

Dixie is correct. The US requires H1's to file returns on worldwide income (if you reside in the country for more than 183 days in a tax year). So you would also be evading taxes if you didn't report the income.

Overall, a very bad idea. You need to talk to an attorney.
