Default Resignation notice

Hi All,

What is the best practice regarding giving resignation notice to current employer for immigrants on H1B. Should I give the standard 14 days notice or just let them know the day I leave them. I am afraid that if my current employer terminates my position right away on hearing that I am leaving them then I may be out of status for a few days.

Please advise. Thanks.

...and arrange it with your new employer so that even if your current employer terminates your position on the same day, you can join your new employer the next day or within a few days so that you do not fall out of status. I would also recommend to get a H1 transfer approval before giving notice to your current employer.

I guess 2 weeks notice is good enough even in H1B cases.

Your initial employment offer might outline the requirement if you had agreed upon for anything. In general, it is a good to give a 2 week notice before leaving. Also be ready, if they accept the resignation effective immediately. Try to depart with good terms with the current employer as in the immigration journey, you might need some reference at later time. Better not to burn any bridges. Notice you are in EB3 based on your profile, Ensure you new employer sponsors your in EB2 if you and job both are qualified.

If your Transfer petition is filed, I dont think you have anything to worry about. I would recommend giving the notice after filing the transfer petition and letting your new employer know that you could start earlier if released earlier by your current employer. Most companies will not have a problem with that.

Last year, on a wed, I gave a 2 week notice to my pvs company and they asked me to leave that very friday.

I, however, made sure that my H1-transfer with my new company (my present) company was already filed, EAD was up to date, etc etc.

Now, my employment history does show a One-week gap. However, I have my resignation letter that states that I had given a two week notice and that I was willing to work till the end of the two weeks. I also have pay-stubs from my pvs company that shows that they paid me for the two weeks. (Perhaps I could have convinced my new new company to take me 1 week earlier?? I thought, and for good reasons, that this would just cause more confusion and would leave a very bad impression on my part.)

So, when you give your notice be prepared. I would also be concerned about other aspects such as health insurance. usually health insurance of your old company should cover you till the end of the month. So, its probably not a good idea to leave during the end of the month. Again, this is a usual case. Please check.

If it is beyond your control and you do end up leaving prematurely, take a break. Go somewhere and relax. Thats what I did.
