Looks like I have collected following options.
1. Claim FMLA from 8th Month and stay in same company.

3. H1 transfer ( If I can find another job) and

I have one more question.
My employer called me and informed on phone that they are terminating my job and they will stop the payroll by end of 4 weeks from that date. When I asked for a written notice they said that the phone conversation is recorded and that is the notice. Is this how it works normally????
There is a good chance you've just hit a jackpot. Your employer's behaviour is a confirmation that this terminatiion is because of your pregnancy, which is illegal and at this point, in my view, the question is not about your termination/status in US but it is of survival of company and probably your employer's personal assets. Yes, if i were you, i would file a complaint with EEOC, they could fight the case on your behalf, the employer would have to either make your life or file for bankrupcy. It is unlikely they have a documented policy to fire everyone on bench, it will be next to impossible to prove that policy. I would not negotiate pay/medical/H1/leave etc. that would make you look weak, i would contact EEOC or hire a lawyer and send him/her a notice. Calling the employer, returning the call or answering the phone would be a mistake in my opinion. I had gone thru a few levels back in 2002 when i was laid off. It's not as hard as it sounds. i think your employer has made a big time mistake and its really upto you whether you want to fight this winning battle. this is your chance: you could be the Rosa Parks of all pregnant women.

could you post some more info of employer like: # of employees, approx yearly revenue, services provided, # of offices, desi/american employer etc.

if he is a desi employer, one letter from EEOC asking for explanation will bring him to your feet.
