Question Vistor Visa for younger brother!!!

My younger brother has a visa interview next week at Delhi consulate.

Some facts
-I am on h1b (came as a student in 2002)
-My Parents are currently in US. This is 3rd trip to US.
-My Sister and Brother in law are GC holder alongwith 1 GC holder kid and 1 USC kid.
-We are expecting

I am not sure how these facts will be seen @ visa interview by the officer as he can easily think that my younger brother is a potential immigrant.

There is one big supporting fact and that is my brother has an admit to IIM which he has to join in Jun last week. He just wants to come here for 1 month.

Anyone out here has any suggestion which might help for stamping? DS 156 I have clearly disclosed about my Sister having a GC and parents being here can be asked in interview.

Any suggestion will be highly appreciated.

if your brother has already paid his fees in IIM make sure he takes that fee recpt with him to show the officer. Tell him to mention that he is looking at spending some time with his whole family together and getting a nice vacation before starting to slog for the next 2 years.
If your brother has any assets in his name like house, car or any stocks, etc then take those docs along to show the consular officer. The consular officer merely needs to be satisfied that he will come back after his trip and not stay back. Expect questions like why did you choose IIM and not a US University, etc and be prepared for a good answer.

In most cases, when a consular officer sees someone who is meritorious they are usually very courteous.

You make a good point of making sure the fee receipt or admission information is taken to the US consulate. The key is to somehow prove that he is not settling down in US.

My 2 cents....I do not think it is wise to say all the family members are in US unless asked. Because that will only make the counseller feel that he may settle down in US. The best advise i can give is be yourself. Answer to the point. Be presentable and greet when you meet. Definately mention about the admissions at IIM.

another piece of advice, stay away from informing the visa officer about anyone in the family in the US being pregnant. Usually this is more of a concern when parents are visiting, but even for your bro its safer to keep that under wraps.

There's no need to try and shove any information unless asked, and in the process appear too eager to prove intent to return. Just ask your brother to keep all his documentation in order, and that includes admission letter & fee payment receipts etc to show if asked. He can definitely mention purpose of visit as a short, relaxing vacation before coming back to slog on his MBA like crazyghoda mentioned. Just ask him to stay relaxed and truthfully respond to questions with mostly to-the-point answers.

From my brother's experience, your papers are more important. He should have your employment letter, H1 I-797, and your I-134 affidavit of support form with supporting documentation, and optionally a letter from you inviting him & stating purpose of visit. They already know from your I134 if you have sponsored your parents. In our case, they quickly checked upon me and granted him a visa.

Having said that, standard disclaimer of "Your mileage may vary" applies. My best wishes for your brothers interview.

His brother HAS to state which family member is currently in the US. Its on the form. If he lies, he will never get a US Visa.

Well he could not get visa stamping and was rejected. The VO said he can not issue a visitor visa to a young guy (24 yr old) -

I am still to get more details from him about the interview.

Any suggestions? Shall he re-apply or it is of no use? He at some point of time in future might need to come to US on work visa (no one knows when) so will rejection of Visitor Visa have any negative impact in future??

Do not have to worry abt the future. It will not be an issue. My first visitor visa vas rejected, and i was able to receive my h1 stamping (three times) without any problem (offcourse i mentioned in the visa application about my prior visa rejection).

I went through similar problem when my sister was going for visitor visa. Here are few things you need to keep in mind:

1. Binding to go back to home country
- Proof of family members back in home country
- Proof of current job or education - IIM receipt will help.
- Proof of assets in home country

2. Financial capacity
- Proof of assets in home country
- Proof of about $5-6K liquid money
- Earning / Income.

3. Not a potential immigrant
- Limit of stay - 3-4 months return ticket.
- If working, company's letter that his employment will still be valid once returned.

You don't need anything else. My best wishes.

The VO said all the required documents are good. He was asked for how long he wants to be in US.(answer was 1 month)

VO said he can not issue visa as he is too young. "We are not issuing visa for people of your age."

Its just a bad luck. Try again. I have visitor visa for whole family and in-laws except my father in law had to go twice - rejected first time saying potential immigrant - sounds familiar?

Default Not a good excuse

My nephew and niece got visit visa for another 10 years last month. Their 10 year visa was expired last year. They are now 18 and 16 years of age. They got their visa stamped in Kuwait. They did come here and left within 1 month for all their 5 visits. So the VO convince their intention (just for visit). So age is not problem, VO is not convinced most young guys (Indian) intentions. They give visit visa for young guys from Europe and other countries.
