How to sponser in-laws on Visitor visa

I'm from India (H1) and want to sponser my in-laws to come to US on visitor visa. They have got a visa appointment in US consulate MUMBAI in March. Please inform me the procedure for this and what documents I need to send for their interview.


My H1 visa expires in May 2007. My company will apply for H-1 extension in either Feb or March. Considering this, Can I still sponser visitor tourisr visa for my in-laws while my H1 extension is pending? Do I have to get my extension approved? Please advice

you need to send notarized form I134, bank letters, employment letters, your passports, birthcertificates and your inlaws need to carry their proof of residence, property, job, etc.

Sorry to digress a bit, but don't companies usually apply for renewal six months before the H1-B visa expires? Taking into account the time for any questions that may arise. I am guessing, your company wants to pay more, using premium processing, as you don't have much time between Feb./March and May '07 deadline. Their company policy, if it is such, is causing you this personal problem, you might want to discuss this with them. Like most corporates they might want to work with you on this, to keep their employees happy.

I have e-mailed the company attorney twice allready. I have not got any response.

Only thing I need to know is at the time of the visitor visa interview at Mumabi consulate (march 2007) for my in-laws, Do I have to have my I-797 (extension) approved? My current I-797 will expire in May 2007. My company will file extension in Feb 2007

As long as you apply for the extension even 1 day before your visa expires, it is ok. That is what my lawyer told me and I believe you will find the same info on INS website also. As long as you application is pending u r in status.

Beats me, given the current context where this person is facing this issue why would anyone recommend filing Visa extensions one day before the deadline?

Also, if he himself wants to travel outside of US in May '07, he will not be able to. I am not sure if he can travel on, "Applied for Extension" status.
